StubHub Hit With $5M Class Action Lawsuit Over Coronavirus Refund Policy

A Wisconsin man has filed a $5 million dollar federal class action lawsuit against StubHub for not refunding money he spent on a suspended NHL game.

Filed by plaintiff Matthew McMillan last Thursday in U.S. District Court in Wisconsin, the complaint accuses the ticket resale company of breach of contract and negligent misrepresentation, among other claims. McMillan is asking the court to prohibit StubHub from issuing coupons worth % of the purchase price in lieu of refunds and to order the company to reinstate its pre-March 20 refund policy.

According to his complaint, McMillan says he purchased two $ tickets on StubHub in early March to attend an NHL game between the Winnipeg Jets and the Minnesota Wild. When the NHL announced on March 12 the season had been suspended due to the spread of the coronavirus, McMillan asked StubHub to refund his money.

McMillan says StubHub told him he could not receive a refund because the game had not been canceled but only postponed, despite the fact that he had purchased his ticket with StubHub’s money back guarantee policy and that he is all but certain the game will eventually be canceled. He says he was told he would be given a coupon that expires in 12 months and not the monetary refund he requested.

McMillan’s lawsuit states that for years, StubHub has touted its “FanProtect guarantee,” promising users they would receive a full money back refund if an event was canceled. The complaint notes that on March 12, StubHub president Sukhinder Singh Cassidy sent out an email to users stating that while refunds would still available for canceled events, it would also be offering coupons for % of the original order price as an alternative. Then, on March 25, StubHub amended its policy, stating that “if the event is canceled and not rescheduled, you will get a refund or credit to use on a future purchase, as determined in StubHub’s sold discretion (unless a refund is required by law).”

In a subsequent email sent March 30, Cassidy announced that the company had changed its longstanding refund policy because the coronavirus crisis&#; impact on the touring industry had put StubHub in an untenable position. “We are facing significant timing delays in recouping funds from the thousands of sellers on our platform, and expect these challenges to continue in the coming months,&#; Cassidy wrote in the email. The new policy stated customers would be offered a % credit for canceled purchases as a “thank you for remaining patient in a very challenging period.”

The March 30 email went on to state that 70% of customers had already chosen that option and that StubHub would now be using the coupon alternative as its “standard policy for canceled events, with refunds available in jurisdictions where they are required.”

According to McMillan&#;s complaint, neither he nor other StubHub customers were informed of or agreed to this new policy.

“Instead of instituting responsible financial transaction policies, (StubHub) made it their practice to pay ticket sellers before the event had occurred, exposing themselves to the possibility that they would be left holding the bag (or have to ignore their own guarantee and cheat their customers) if an event was cancelled and they could not promptly collect from sellers,” the complaint states.

McMillan&#;s attorney Nick Coulson tells Billboard StubHub’s conduct is egregious.

“Dumping promised refunds for expiring coupons during the time of greatest financial suffering in recent history is cruel and wrong,” Coulson says. “Especially because people have no idea if they&#;ll even be able to use the coupons &#; we don&#;t know what the next 12 months are going to look like. To the extent that StubHub claims financial constraints have forced its hand (into its customers&#; pockets), those constraints are entirely of its own making. Through this action, we hope to provide people some small bit of relief during this uncertain time.”

A spokesperson for StubHub told Billboard the company does not comment on pending litigation.

MONTREAL — StubHub plans to beef up its operations north of the border this year with the launch of a Canadian website, French-language services and the ability to buy and sell tickets in Canadian currency.

The ticket reseller, a subsidiary of eBay headquartered in San Francisco, said it wants to address shortcomings in the Canadian market, its second-largest after the United States.

“There is an obvious opportunity for us to better serve consumers here in Canada with a localized product,” Jeff Poirier, general manager of StubHub Canada, said in an interview.

Canadians looking to buy or sell tickets on StubHub for games, concerts and other events have to do so in U.S. currency, a small but nonetheless nagging inconvenience for some users of its website.

Poirier said the Canadian currency option will be added with the launch of a Canadian website in the second half of the year for events in Canada, and eventually consumers will be able to purchase tickets to events around the world in Canadian dollars.

Canadian scalper's multimillion-dollar StubHub scheme exposed in Paradise Papers

​When Adele fans went online to buy tickets to the pop superstar's world tour last year, they had no idea what exactly they were up against.

An army of tech-savvy resellers that included a little-known Canadian superscalper named Julien Lavallée managed to vacuum up thousands of tickets in a matter of minutes in one of the quickest tour sellouts in history.

The many fans who were shut out would have to pay scalpers like Lavallée a steep premium if they still wanted to see their favourite singer.

An investigation by CBC/Radio-Canada and the Toronto Star, based in part on documents found in the Paradise Papers, rips the lid off Lavallée's multimillion-dollar operation based out of Quebec and reveals how ticket website StubHub not only enables but rewards industrial-scale scalpers who gouge fans around the world.

CBC News obtained sales records from three U.K. shows that provide unprecedented insight into the speed and scale of Lavallée's ticket scam.

Despite a four-ticket-per-customer limit, his business snatched up seats in 25 minutes, charged to 15 different names in 12 different locations.

The grand total? Nearly $52, worth of tickets at face value.

'Simply not feasible'

Lavallée's name appears over and over in the records, alongside the names of his wife, his father and other friends and family. The records show them somehow buying tickets from different locations around the world at the same time, placing orders from cities like Chicago, Los Angeles, London and Montreal.

"The speed of the transactions — this isn't somebody sitting there typing details over and over again," said Reg Walker, a U.K. event security specialist hired by some of London's biggest concert venues.

CBC News and the Star showed Walker the U.K. sales records.

"Given the success rate, even if you had a dozen people sitting there typing their details over again, you would not get these results," he said. "It's simply not feasible."

Lavallée's name is very familiar to Walker. He says he's spotted Lavallée targeting tickets for many U.K. concerts and suspects the Canadian is using multiple identities and aggressive software, known as bots, to trick the system.

Walker says there is no legal way for people located in the U.K. to "harvest" tickets.

"If you pretend to be multiple consumers, or if you pretend to be a consumer and you are acting as a business, it's a criminal offence."

CBC's investigation has found a patchwork of anti-scalping laws around the world that are seldom enforced or don't always apply to scalpers working across international boundaries like Lavallée.

Big money

The leak of tax haven records known as the Paradise Papers reveals for the first time the vast sums of money involved in Lavallée's ticket operation, which is part of a global scalping industry that experts value at $8 billion.

Lavallée, who got his start in his early 20s reselling hockey and concert tickets while living at home with his parents, now runs an international ticket harvesting operation.

Financial records detail $ million in gross sales in alone.

On his resume, he describes himself as a "ticket broker" and lays out plans in to expand into the U.K. in a "partnership" with StubHub.

"The staff at StubHub told me that he was one of their biggest global resellers," Walker said.

StubHub's 'top seller' program

CBC and the Toronto Star have discovered StubHub actually has a program to forge relationships with those it calls its "top sellers."

StubHub, which promotes itself as a "fan to fan" resale site, now operates in 47 different countries but discloses very little on its website about where it gets its massive inventory.

But the CBC/Star investigation also discovered a password-protected portal exclusively for StubHub's top sellers who prove they can move more than $50, worth of tickets a year.

The company offers them special software to upload and manage huge inventories of tickets.

In its Top Seller Handbook, Stubhub offers incentives for high-volume resellers, including reducing its 10 per cent cut on each ticket sold. The higher the reseller's numbers, the sweeter the deal, with special rates for those who hit sales of $,, $, and up to $5 million US per year.

In a statement, StubHub acknowledged it has a top seller program but refused to say how many people are enrolled or what percentage of StubHub's overall supply comes from industrial-scale scalpers.

StubHub also refused to comment on Lavallée and his claims of a "partnership" with the company. StubHub said it "holds all sellers to a very high standard and requires they follow all relevant laws."

The company declined to elaborate on how it monitors and vets its top sellers, but said it does not condone illegal purchases of tickets

"StubHub agrees that the use of bots to procure tickets is unfair and anti-consumer. StubHub has always supported anti-bots legislation and encourages policy-makers to look comprehensively at the host of factors that impact a fan's ability to fairly access, buy, resell, or even give away tickets in a competitive ticket market."

Lavallée's response

Lavallée has run multiple companies, including one registered in Quebec, and another across the Atlantic on the British Isle of Man, a well-known tax haven.

One of CBC's partners knocked on the door at the company's Isle of Man address but nobody there had heard of Lavallée.

CBC and the Toronto Star did track him down at newly rented offices in suburban Montreal where he runs a company called Ticketaria.

Lavallée, his wife and father, who work together in the business, all declined to answer questions.

In an emailed statement, his lawyer said Ticketaria "carries out all its activities in accordance with the laws and rules of the jurisdictions in which it operates and sells."

​Who gets hurt?  

Quebec actually has a law aimed at banning the resale of tickets for profit. But, like in many jurisdictions, the law is unclear as to how far it reaches and whether it applies to people who buy and sell tickets outside of the province.

What's clear, says John Karastamatis of Toronto's Mirvish Productions, is "no one can regulate the internet yet."

His theatre witnessed Lavallée buy up tickets for the smash hit Book of Mormon in , as did many other scalpers who resold them for huge profits.

"Governments more or less think scalping is not a real crime," he said. "They think it's victimless crime. 'Who gets hurt?' And so nobody pays a lot of attention to it."

In that email, Cassidy outlines to their “valued StubHub customer” base that there really isn’t anything to worry about when it comes to tickets they purchased. Yes, the coronavirus is causing issues with everything ranging from everyday life to professional sporting events and everything in between, but StubHub wanted to assure everyone they would be taken care of.

Take a look at what they promised those valued customers (emphasis is theirs):

If you bought tickets on StubHub and your event is still happening, you are good to go! If you can no longer attend your event for any reason, you can sell your tickets with confidence on StubHub in just a few quick steps.

If you bought tickets on StubHub to an event that is cancelled, you have two options:

Just three weeks later, the company issued an update on their coronavirus policy. You might noticed something is missing.

“I want to assure you that StubHub’s FanProtect Guarantee protects every purchase — the ticket you have purchased on our site will get you into the event or we will make it right,” reads the update, which is also signed by Cassidy. “And StubHub’s award-winning customer service is on standby to help with any issues or concerns.

“If you buy tickets on StubHub to an event that is canceled, you are covered by our FanProtect Guarantee. MONTREAL — StubHub plans to beef up its operations north of the border this year with the launch of a Canadian website, French-language services and the ability to buy and sell tickets in Canadian currency.

The ticket reseller, a subsidiary of eBay headquartered in San Francisco, said it wants to address shortcomings the bank of greene county login the Canadian market, its second-largest after the United States.

“There is an obvious opportunity for us to better serve consumers here in Canada with a localized product,” Jeff Poirier, general manager of StubHub Canada, said in an interview.

By June, StubHub will also feature French-language capabilities and French customer service will be available in an effort to better compete with other ticket resellers that are bilingual, such as mynewextsetup.us and Ticketmaster, he added.
