What to do if your debit or credit card gets stuck in an ATM

WHY DOES IT HAPPEN?

A debit or credit card can get stuck in an ATM for two reasons—error in connection, or delay in entering details. In case of fluctuation in power supply or network connection, the machine may be unable to link the information that you have fed, to the central system. This will cause an error due to which the card might get stuck.

There’s also a possibility of the ATM swallowing a card because a customer takes too long—more than a minute—to enter details such as withdrawal amount, personal identification number (PIN), or any other. Till some years back, if a blocked card was used at an ATM, the machine would swallow it. But now, most machines display a message—‘invalid card’—and reject the card. Same is true if you key in the wrong PIN thrice.

Regardless of whether the card is stuck in an own-bank ATM or another bank’s ATM, it will be submitted to the bank that operates the ATM. If your card is stuck in an own-bank ATM, the vendor who cleans or reloads the machine will submit the card to your bank. Similarly, if it is stuck in an other-bank ATM, the vendor will submit it in the bank that operates the ATM. The operating bank will inform the other bank based on a common protocol that is followed by all banks under regulatory guidelines.

WHAT SHOULD YOU DO?

First and foremost, immediately inform your bank. Call the customer service department of your bank and give details of the ATM or place where the card has got stuck. You have two choices—block the card, or get it retrieved.

You may want it blocked so that it isn’t misused by anyone. The bank will send the replacement card and its PIN through post to your registered address, usually within days. Alternatively, you could visit the nearest bank branch to get a replacement card instantly. Remember to carry your identification proof, such as Permanent Account Number (PAN) card. The procedure varies across banks. Such replacement cards are free of cost.

If you are sure that the card is indeed stuck in an ATM and know that machine’s location, you can inform the operating bank, which will arrange for the same card to be retieved and sent to you or to a convenient bank branch.

The procedure is the same if a credit card gets stuck in an ATM. The replacement card will, of course, have a different number and PIN, but all other features will remain the same as the previous card’s.

Verdict

Fifth Third Bank offers a great deal of convenience for customers within their geographic footprint, enhanced by the fee-free ATM network nationwide. The number of products and services provided, as well as the savings and other incentives Fifth Third offers to customers with multiple accounts, means this can be a great one-stop-shop for all of your banking and financial activities. However, given the high monthly maintenance fees and low APYs, customers may find that their checking accounts cost more and their interest-bearing accounts pay less than competitors'.   • Who is included in the Settlement?

    You are a member of the Settlement Class if you are a Current Account Holder or Former Account Holder of Fifth Third Bank who, between January 1, and October 31, , either (1) was assessed one or more Non-Fifth Third ATM Fees for making a balance inquiry at an ATM outside of Fifth Third Bank’s network of ATMs; or (2) was assessed more than one Non-Fifth Third ATM Fee for undertaking a balance inquiry during the same ATM visit as a cash withdrawal or other funds transfer. Excluded from the Settlement Class are Fifth Third Bank, its parents, subsidiaries, affiliates, current officers and directors; all customers who make a timely election to be excluded; and all judges assigned to this litigation and their immediate family members.

    If you were not assessed at least one Non-Fifth Third ATM Fee between January 1, and October 31, for making a balance inquiry at an ATM outside of Fifth Third’s network of ATMs, you are not a member of the Settlement Class.   • What does the Settlement provide?

    Fifth Third has agreed to establish a cash Settlement Fund of $ million from which Settlement Class Members will receive payments or Account credits. Pursuant to the Court’s approval, the Settlement Fund will also be used to pay Settlement Administration Costs, Service Awards for the Class Representatives, attorneys’ fees awarded to Class Counsel, and reimbursement of Class Counsel’s litigation costs. The Settlement Fund, net of any Settlement Administration Costs, Service Awards, and attorneys’ fees and expenses award by the Court, will be divided by the total number of unique Accounts, which will yield the amount of each Settlement Class Member Payment.  Settlement Class Members with jointly held accounts will receive only one Settlement Class Member Payment per unique Account and each Settlement Class Member Payment will be the same, regardless of how many Non-Fifth Third ATM Fees were assessed against a unique Account for undertaking balance inquiries at ATMs outside of Fifth Third Bank’s network of ATMs. 

    Within one year after the date the Settlement Administrator mails the first Settlement Class Member Payment, any remaining amounts resulting from uncashed checks, known as Residual Funds, will be distributed as follows. First, any Residual Funds up to $, shall be payable to Fifth Third Bank for the Settlement Administration Costs it paid as part of the Settlement Fund. Second, if the Residual Funds are in excess of $,, Class Counsel and Fifth Third Bank shall seek the Court’s approval to distribute any Residual Funds above $, to a cy pres recipient if an additional distribution to Settlement Class Members is not feasible or practical.

  • How do I receive a payment or Account credit?

    If you are in the Settlement Class and entitled to receive a payment or Account credit, you do not need to do anything to receive a payment or Account credit. If the Court approves the Settlement and it becomes final and effective, you will automatically receive a payment or Account credit.

    If you stay in the Settlement Class, all of the decisions by the Court will bind you, and you give Fifth Third a “release.”  A release means you cannot sue, continue to sue or be part of any other lawsuit against Fifth Third about the legal issues in this case. Section XIII of the Settlement Agreement contains the release and describes the precise legal claims that you give up if you remain in the Settlement.     This lawsuit has been prosecuted on behalf of the proposed Class Representatives on a wholly contingent basis.     If you are a Settlement Class Member and have not requested to be excluded from the Settlement Class, you can object to any part of the Settlement, the Settlement as a whole, Class Counsel’s requests for attorneys’ fees and expenses and/or Class Counsel’s request for Service Awards for the Plaintiffs as Class Representatives. To object, you must submit your objection by mail or private courier (e.g., Federal Express) to the Clerk of the Court, Class Counsel, and Fifth Third’s counsel.     • Your full name, address and telephone number;
    • All grounds for the objection, accompanied by any legal support for the objection known to you or your counsel;
    • The number of times the objector has objected to a class action settlement within the five years preceding the date that the objector files the objection, the caption of each case in which the objector has made such objection, and a copy of any orders related to or ruling upon the objector’s prior objections that were issued by the trial and appellate courts in each listed case;
    • The identity of all counsel who represent you, including any former or current counsel who may be entitled to compensation for any reason related to the objection to the Settlement or fee application;
    • A copy of any orders related to or ruling upon counsel’s or the counsel’s law firm’s prior objections that were issued by the trial and appellate courts in each listed case in which the objector’s counsel and/or counsel’s law firm have objected to a class action settlement within the preceding 5 years;

  • What’s the difference between objecting and excluding?

    Objecting is telling the Court that you do not like something about the Settlement. You can object to the Settlement only if you do not exclude yourself from the Settlement. Excluding yourself from the Settlement is telling the Court that you don’t want to be part of the Settlement. If you exclude yourself from the Settlement, you have no basis to object to the Settlement because it no longer affects you.

    The Court’s Final Approval Hearing

    The Court will hold the Final Approval Hearing to decide whether to approve the Settlement and the request for attorneys’ fees, litigation expenses and costs, and Service Awards for the Plaintiffs. You may attend and you may ask to speak, but you don’t have to do so.  If you retain your own counsel, they may appear on your behalf.

  • When and where will the Court decide whether to approve the Settlement?

    The Court will hold a Final Approval Hearing at am on July 8,  at the United States District Court for the Southern District of Ohio located at the Potter Stewart U.S. Courthouse, Courtroom , East Fifth Street, Cincinnati, Ohio The hearing may be moved to a different date or time without additional notice, so it is a good idea to check at mynewextsetup.ushirdoutofnetworkbalanceinquiryfeemynewextsetup.us for updates. At this hearing, the Court will consider whether the Settlement is fair, reasonable and adequate. The Court will also consider any request by Class Counsel for attorneys’ fees and expenses and for Service Awards for the Class Representatives. If there are objections, the Court will consider them at this time. After the hearing, the Court will decide whether to approve the Settlement. We do not know how long these decisions will take.

  • Do I have to come to the hearing?

    No. Class Counsel will answer any questions the Court may have. However, you may come at your own expense. If you send an objection, you don’t have to come to Court to talk about it. Provided you submitted your written objection on time, to the proper address, and it complies with the requirements set forth above, the Court will consider it. You may also pay your own lawyer to attend, but it’s not necessary.

    YOU ARE NOT REQUIRED TO ATTEND THIS HEARING TO BENEFIT FROM THE SETTLEMENT.

    How to Avoid High ATM Fees

    How can I get cash using my card?

    You’ve got a few options.

    ATMs. You can get cash at millions of ATMs worldwide. There are also 40, surcharge free ATMs nationwide where you can get cash with your Wisely® Pay card. Click here or log into myWisely® to find in-network, surcharge-free ATMs in your area.5

    What are pending transactions?
    This is the amount of money that has been set aside for purchases made with your card, but has not yet been collected by the merchant.

    What is a pre-authorization hold?
    Certain purchases (hotels, restaurants, car rentals, gas stations, etc.) require pre-authorization and may temporarily hold money from your card balance that would be greater than the actual purchase amount once the purchase is processed. The money will be released, and your balance will be adjusted. Availability of the pre-authorized money could take up several days to be released into your card balance.

    Gas Stations. When using your card at gas stations, it is best to prepay for the exact amount at the cashier. If you pay at the pump, a hold of up to $ or more may be placed on your card. This hold may last up to 5 days. (Hold times may vary depending on the merchant.)
